1 The short version

Patemo is distributed through Apple’s App Store and Google Play. The store handles payment and refunds under its own terms. Your videos and everything you add stay on your device and remain yours. Rally finding and stroke suggestions help you review your matches; they can be wrong, and you can always correct them. Your mandatory consumer rights always apply.

3 Your licence to the app

When you get Patemo, we grant you a personal, non-transferable, non-exclusive licence to use it on compatible devices you own or control, in line with the applicable store’s usage rules. The app, its name, design and code remain ours; please do not copy, resell, reverse-engineer or redistribute it, except where the law expressly allows.

4 Purchases through Apple and Google

On iPhone and iPad, Patemo is distributed through Apple’s App Store under Apple’s standard licensed-application terms, which apply alongside these terms. Apple is the merchant of record and handles payment, taxes and refunds; you can ask Apple for a refund at reportaproblem.apple.com.

On Android, Patemo is distributed through Google Play, which handles payment through its billing system. Refund eligibility depends on the purchase and applicable rules; see Google Play’s refund policy.

If something does not work, write to support@patemo.com anyway: we would rather fix the problem. Your mandatory consumer rights remain unchanged.

5 Patemo Plus subscription

Nothing in Patemo is for sale yet. When Patemo Plus is offered, the purchase screen and the store page will show what it unlocks and its price before you buy, and these rules apply:

• Auto-renewing. The subscription renews automatically for the same period (for example monthly or yearly) at the price shown, unless you turn off auto-renew at least 24 hours before the current period ends.
• Billing. Payment is charged to your Apple or Google account when you confirm the purchase, and again at each renewal.
• Managing and cancelling. You manage or cancel the subscription in your Apple account settings or in Google Play. Cancelling stops the next renewal; you keep Plus until the end of the period you have already paid for.
• Your material stays yours. Your videos, labels and saved reports remain available in the app after a subscription ends.

6 Your data is yours

What you import and create in Patemo is kept on your device. How the app handles data is described in our privacy policy. Match videos can show other people: you are responsible for having any permission you need to record them and to share clips of them.

7 Analysis and drills

Patemo finds rallies and suggests strokes automatically, on your device. These results can be wrong or incomplete; check them and correct them where needed. Patterns and progress are based on the labels in your own videos. Drills are general training suggestions, not personal coaching or medical advice: train within your own abilities and stop if something hurts.

8 Using this website

You may use this site for your own information. Please do not misuse it: no attempts to break, overload, scrape at scale, or gain unauthorised access to it. The content, design, names and logos on this site are ours or our licensors’ and are protected by intellectual-property law; you may not reuse them without permission.

9 Conformity and what we can’t promise

We provide Patemo and this website with reasonable skill and care, and keep the app in conformity with what we describe, including the updates, security updates among them, needed for it to keep working as described for a reasonable time. This is in addition to your statutory rights for digital content under EU and Dutch law.

No software is perfect. To the extent the law allows, the app and this website are provided “as is” and “as available”. Nothing here excludes or limits any warranty or right that may not lawfully be excluded or limited, including your mandatory rights as a consumer.

10 Limitation of liability

To the extent permitted by law, Oomny B.V. is not liable for indirect or consequential loss arising from your use of Patemo or this website, and our total liability is limited to the maximum extent the law allows. This does not limit our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, including mandatory Dutch and EU consumer-protection rules.

11 Apple

For the app obtained through Apple’s App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple is not responsible for the app or its support; we are.

12 Governing law

These terms are governed by the law of the Netherlands, and disputes fall to the competent Dutch courts. If you are a consumer in the EU/EEA, the mandatory consumer-protection rules of your own country of residence always continue to apply.

13 Changes

If we change these terms we will update this page and the date at the top.
